Does UNCROC have any real impact in this country?

TRANSNATIONAL LAW – FAMILY LAW – TUTORIAL ONE

1. Does UNCROC have any real impact in this country?
2. You are consulted by a person who seeks to invoke the Hague Convention. She is a mother who is concerned that her estranged husband will leave the country and return to the country of his birth. What steps should you take?
3. Give some examples of ‘grave risk’ pursuant to Article 13 of the Hague Convention.
4. A mother has taken her six year old daughter, Jewel. from Australia to Booga Booga. It is a small Pacific nation that is not a signatory to the Hague Convention. Booga Booga has a tribal legal system that presumes a mother will care for a child. It does, however, have a recently introduced ‘best interests’ test. Your client, the father, has an Australian custody order. He is Australian. The mother is a Boogian. They were married and divorced in Australia, but lived for seven years in Booga Booga where they practised as doctors before returning to Australia. After coming back to Australia they lived and worked here for fourteen moths. During this time the parties separated and divorced. The custody order was obtained after a contested hearing. The father had claimed that if his wife was granted custody that she would simply leave Australia with Jewel. As it turned out she did leave with a Boogian passport that had mistakenly been issued to her including Jewel. What can your client do to have Jewel returned to Australia?
5. Give some examples of how the Child Protection Convention may have application in Australian Family Law cases.
The tutorial will involve a general discussion of each of the above questions.
