Barry Appleseed enters into a contract with Deliveryman, Inc. for Deliveryman to transport Barry s apples from his farm in the state of Washington to a grocery store in the state of Maryland. Deliveryman is a common carrier. While transporting the apples, there was a wild fire that closed all interstate traffic in Washington for 7 days. When the fire was contained and travel resumed it took Deliveryman 3 days to complete the delivery of apples to the store in Maryland. By that time (10 days), the apples had rotted and were not suitable for sale by the grocery store. That store makes a claim for damages against Deliveryman stating that the trucking company, as a common carrier, had a duty of strict liability to the store and it was therefore responsible for the store s losses in being unable to sell the apples. Is Deliveryman legally liable to the grocery story? Yes or no. If so why so or if not, why not?
John Tenant enters into a written lease with Apartments RU for a 1 year residential lease of a luxury 2 bedroom penthouse. John is single, 30 years old, enjoying the good life and in excellent health. Several weeks after living in the apartment, John develops a severe allergic reaction and seeks medical attention. His doctor tells him that his allergic reaction is due to the mold that is present throughout his apartment. John tells Apartments RU to hire a contractor to perform mold remediation of the apartment. The landlord hires a contractor to eliminate the mold. That contractor, for the next 2 months, is unsuccessful in attempting to eliminate the mold that permeates the apartment and continues to cause John to experience severe allergic reaction to the mold. What option(s) does John have in attempting to break the remainder of the lease period? Will he be successful, yes or no? If yes, why; if no, why not?
